The Knoti Group Pty Ltd - Website Terms of Use

1. Definitions

"Platform"/"We"/"Us"/"Our" refers to the website and services operated by The Knoti Group Pty Ltd (ACN 694 837 968).

"User"/"You"/"Your" refers to any individual or entity accessing or using the Platform.

"Content" refers to any text, images, advertisements, or other materials posted by Users on the Platform.

By accessing or using the Platform, you agree to be bound by these Terms. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use constitutes acceptance of the modified Terms.

3. User Obligations and Content Rules

You agree to use the Platform in compliance with all applicable Australian laws. Specifically:

3.1 Prohibited Content: Any discussion or promotion of illegal or highly sensitive subjects, including but not limited to drugs, weapons, and other controversial topics, is strictly prohibited. The system will automatically filter and block content containing related keywords.

3.2 Advertising Authenticity: All advertisements and promotional statements must be truthful, accurate, substantiated, and must not mislead or deceive consumers. You bear full legal responsibility for all Content you publish.

3.3 Age Restriction: You warrant that you are at least 18 years of age.

3.4 Platform Points: The points used on this Platform are virtual units for internal use only. They may be transferred between User accounts in accordance with Platform rules but cannot be exchanged, redeemed, or converted into fiat currency or any form of real-world monetary value. All purchases of Platform Points are final and non-refundable.

4. User-Generated Content & Moderation

4.1 User Responsibility for Content. You are solely responsible for all Content that you post, upload, or otherwise make available on the Platform, including comments, reviews, and messages ("User Content"). You represent and warrant that you own or have the necessary rights to your User Content and that it complies with these Terms.

4.2 Content Moderation Rights. We act as a neutral hosting service. To maintain the integrity of the Platform and comply with the law, we reserve the right, but are not obligated, to review, monitor, filter, edit, refuse to publish, or remove any User Content at our sole discretion and without prior notice.

4.3 Content Moderation Standards. Actions under clause 4.2 may be taken for reasons including, but not limited to, User Content that we determine:

a) Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy;

b) Constitutes spam, commercial solicitation, or fraudulent activity;

c) Infringes any intellectual property or other proprietary rights of any party;

d) Violates any applicable laws or regulations;

e) Otherwise violates these Terms or is deemed objectionable.

4.4 Automated Tools & No Duty to Monitor. We may use automated systems (including keyword filtering) to assist in moderating Content. This does not imply any duty on us to monitor or review all User Content, nor does it guarantee the removal of all objectionable material.

4.5 No Endorsement. Any action or inaction by us regarding User Content does not constitute endorsement, verification, or assumption of liability for such Content. We do not endorse any opinions expressed in User Content.

4.6 Reporting and Complaints. If you believe any User Content violates these Terms or your rights, you may report it to us via the designated reporting function or by contacting admin@knotiu.com.au. We will review reports in accordance with our internal policies.

5. Intellectual Property

All intellectual property rights in the Platform's content (including text, graphics, logos) are owned by or licensed to Us. You may not reproduce, modify, or commercially exploit any content without Our express written permission.

6. Third-Party Links and Content

The Platform may contain links to third-party websites. These are provided for convenience only. We accept no responsibility for the content, privacy policies, or services of any third-party sites.

7. Disclaimer and Limitation of Liability

7.1 The Platform is provided on an "as is" and "as available" basis without warranties of any kind.

7.2 Platform Role Disclaimer: We act solely as a neutral online advertising publishing platform. We do not participate in, manage, or control any offline services or transactions that may occur between Users. We do not verify, endorse, or assume any liability for the truthfulness, legality, quality, or safety of any advertisements or the consequences of any User's offline actions.

7.3 To the maximum extent permitted by law, We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits.

8. Indemnification

You agree to indemnify and hold harmless The Knoti Group Pty Ltd, its directors, officers, and employees from and against any claims, damages, or losses (including reasonable legal fees) arising from your breach of these Terms, your use of the Platform, or your infringement of any third-party rights.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without prior notice, for any breach of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
